These Terms of Service (“TOS”) govern the access and use of all our web and mobile applications (collectively referred to as “Platforms”) and the products and services provided through them (“Services”). The Platforms are owned, managed, and operated by Cufront Healthcare Technologies Private Limited, with its registered office at 601, B1, Bella Vista Empress, Datta Mandir Rd, beside Shree, Shankar Kalat Nagar, Wakad, Pune, Pimpri-Chinchwad, Maharashtra 411057 (hereinafter referred to as “us,” “we,” “Cufront Healthcare,” or the “Company”).
These TOS apply to your use of the Platforms and Services, whether you are a registered medical practitioner with valid credentials and registered with the Medical Council of India or its future successor organization (“Doctors”), your staff (“Staff”), or the patients and end users using the Platforms (“Patients”). Collectively, Patients, Staff, and Doctors are referred to as “Users” or “you.” By accessing or using the Platforms, registering for Services, or by accepting, uploading, submitting, or downloading any information or content from or to the Platforms, you agree to these TOS.

Your use of the Platforms is subject to these TOS, which may be updated, amended, modified, or revised by Cufront Healthcare from time to time without notice. It is important to refer to these TOS periodically to stay aware of any changes. Your continued use of the Platforms and engagement with Cufront Healthcare constitutes your acceptance of these TOS. Your use of the Services is under a limited, non-transferable, non-licensable, non-assignable license granted by Cufront Healthcare for the purposes mentioned herein.
The Platforms and Services assist Doctors in storing, obtaining, and reviewing health information of Patients visiting their clinics or hospitals. Doctors can review health information such as vitals, medical reports, records, images, etc. (“Data”) and provide relevant feedback, advice, and suggestions. The Platforms enable Doctors to access Patient Data seamlessly and use it to provide healthcare services. While we strive to provide a functional and convenient Service, we do not guarantee compatibility with your web browser or mobile device, uninterrupted availability, or error-free content. Cufront Healthcare is not responsible for service interruptions or platform unavailability due to changes or updates in individual clinic practices, network failures, or technical incidents. We reserve the right to modify, replace, suspend, or discontinue any part of the TOS, Services, or Platforms at any time by posting a notice or informing you through other communication modes. It is your responsibility to check the TOS periodically for changes. Continued use of the Platforms or Services following any changes constitutes acceptance of those changes.
The Platforms may collect and store demographic, financial, health records, and other information you provide, which is processed according to our privacy policy published on the Platforms. Doctors represent and warrant that they have obtained appropriate consent from Patients before storing or sharing their information with third parties. Patients consent and agree that the Platforms may store their personal information for purposes as per our privacy policy.
To register, you need to create an account with a username and password. You must ensure that the information provided is accurate, not misleading, and secure. You are responsible for keeping your credentials safe. Cufront Healthcare will not be liable for any losses or claims arising from misuse of the Platforms or Services accessed with your credentials. You cannot create an account using another person's information, trademarks, vulgar, obscene, or inappropriate words. We reserve the right to suspend or terminate any account in breach with or without notice. Doctors represent and warrant that they are licensed medical practitioners registered with the Medical Council of India (MCI) and there are no legal or regulatory impediments preventing them from practicing medicine in India.
By using the Platforms, you will have access to sensitive and valuable Data, including medical records, personal information, etc. Doctors and Staff agree to treat all Data as confidential and maintain its confidentiality. Doctors and Staff must be aware of Patient confidentiality requirements and observe all applicable duties of care in providing services under these TOS. The Data presented on the Platforms is provided “As-Is” with no warranties or representations on its accuracy and correctness.

In case of breach, all parties shall be liable to pay the Company pre-agreed liquidated damages of INR 1,00,00,000 (One crore only).
The Company shall not share Data with other doctors, clinics, or hospitals, and will not engage in activities construed as “poaching of patients.” Data will be stored on a secure cloud infrastructure or third-party servers. Cufront Healthcare is committed to protecting Users' identities, employing security procedures to protect Data, including secure access, password encryption, secure HTTPS connections, session tokens, role-based database access, and advanced encryption. Personally identifiable patient information is kept confidential and disclosed only as provided under our privacy policy. We reserve the right to access, read, preserve, and disclose necessary information to comply with law, enforce our conditions of use, or protect rights, property, or safety. De-identified and aggregated data may be used for research, communication, debugging, improving algorithms, enhancing clinical decision support software, and communicating new Services and offerings.
You agree to receive communications via email, telephone, mobile phone, and/or SMS from Cufront Healthcare, third-party vendors, or business partners about services, updates, transactional or promotional emails, and announcements. You consent to receive communications at the mobile number provided, even if registered under DND/NCPR list under TRAI regulations. You authorize Cufront Healthcare to share information with third-party service providers or affiliates. Each visit or login to the Platforms will be regarded as a request to receive communication. To opt-out or provide feedback, email writeus@cufront.com. Cufront Healthcare will retain and use your information to comply with legal obligations, resolve disputes, and enforce agreements.
Cufront Healthcare may terminate your access to the Platforms or Services if you fail to comply with these TOS. This results in forfeiture and destruction of associated information and immediate termination of your ability to provide services through the Platforms. Provisions of the TOS that should survive termination will remain in effect, including warranty disclaimers, indemnity, and limitations of liability. Upon service discontinuation, Cufront Healthcare will make reasonable efforts to help you back up your Data in a suitable electronic format.
The Platforms are provided “As Is” and “As Available” without warranty of any kind, express or implied. Cufront Healthcare and its directors, employees, agents, suppliers, sponsors, and partners do not warrant that the service will be secure, available at any time or location, error-free, virus-free, or that the results of using the service will meet your requirements. Your use of the service is solely at your own risk.
You shall defend, indemnify, and hold harmless Cufront Healthcare, its affiliates/subsidiaries/JV partners, and their employees, contractors, directors, suppliers, and representatives from all liabilities, losses, claims, and expenses arising from your use or misuse of the Platforms or Services, or your violation of the TOS or any applicable law. Cufront Healthcare reserves the right to assume exclusive defense and control of any matter otherwise subject to indemnification by you, requiring your cooperation.
In no event shall Cufront Healthcare, its affiliates/subsidiaries/JV partners, or their directors, employees, agents, suppliers, or partners be liable under any theory of liability, whether in contract, tort, negligence, breach of statutory duty, or otherwise, for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, personal injury, or property damage related to your use of the service, even if Cufront Healthcare was advised of the possibility of such damages.
These TOS and any claims, disputes, or causes of action arising out of or related to these TOS shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. The courts in Pune, Maharashtra, India, shall have exclusive jurisdiction over any disputes arising out of or in connection with these TOS or your use of the Platforms or Services.
These TOS constitute the entire agreement between you and Cufront Healthcare regarding the use of the Platforms and Services, superseding any prior agreements between you and Cufront Healthcare. If any provision of these TOS is found to be unenforceable, the remaining provisions shall continue to be in full force and effect. The failure of Cufront Healthcare to enforce any right or provision of these TOS shall not constitute a waiver of such right or provision. You may not assign or transfer these TOS, or any rights or obligations under them, without Cufront Healthcare's prior written consent. Cufront Healthcare may freely assign these TOS.
